4. INFORMATION ON THE WEBSITE

We aim to ensure that information on the Website is useful and accurate. However, content is provided for general information about Mufasa and our services.

Website content does not necessarily constitute a formal offer, quotation, professional advice or contractual commitment.

We may update, amend or remove Website content at any time.

Although we take reasonable care when preparing and maintaining the Website, we do not guarantee that all information will always be complete, current, accurate or free from errors.

You should contact us directly if you require confirmation of any information or wish to discuss a particular project.

5. ONLINE CALCULATION TOOL AND ESTIMATES

The Website may include a calculation tool that allows visitors to estimate the potential cost of video production, photography or related services.

The tool is intended to provide an indicative estimate based on the options and information entered by the visitor.

Calculations may not account for every factor affecting the final price, including the complete project scope, equipment availability, crew requirements, location, travel, scheduling, post-production, revisions or other project-specific requirements.

Accordingly, calculations generated by the Website are indicative only.

A calculation does not constitute a binding quotation, offer or agreement to provide services at the displayed price.

A final quotation will be subject to Mufasa’s assessment of the project requirements and confirmation of the applicable terms.

Where you submit a calculation or related enquiry to Mufasa, we may use the information you provide to review your requirements and prepare a response or quotation. Our handling of that information is explained in the Privacy Policy sections below.

6. INTELLECTUAL PROPERTY

Unless otherwise stated, materials published on the Website, including text, photographs, videos, graphics, designs, documents, logos and other content, are owned by Mufasa, licensed to Mufasa or used with the appropriate rights or permissions.

All rights in these materials are reserved to their respective owners.

You may view and access Website materials for your personal or legitimate business purposes.

Except where permitted by applicable law or authorised by the relevant rights holder, you must not reproduce, republish, modify, distribute, sell, commercially exploit or otherwise use Website materials without prior permission.

Nothing in these Terms and Privacy Policy transfers ownership of intellectual property to Website visitors.

Third-party names, logos, trademarks and other materials remain the property of their respective owners.

7. CLIENT NAMES, LOGOS AND PORTFOLIO MATERIALS

Mufasa may display client names, logos, project references, videos, photographs and other materials to demonstrate our services, experience and completed work.

Such materials may be used under a licence, contractual permission or other applicable authorisation, subject to intellectual property rights, confidentiality obligations, contractual restrictions and applicable law.

Our portfolio may include references to clients and examples of projects we have completed.

Where permitted by the applicable arrangements, we may identify a client by name or logo in a client list, presentation, case study, proposal, portfolio or other promotional material.

We may also use selected completed videos, photographs or other production materials to demonstrate our work on our Website, in business presentations, in proposals or through our official promotional channels.

Where a client has publicly released or published a video or photograph produced by Mufasa, we may consider that material for portfolio use, subject to the applicable contract, necessary permissions, intellectual property rights, confidentiality obligations and data protection requirements.

Public availability alone does not automatically grant Mufasa every right necessary to reproduce or republish a video, photograph or other material.

Where a client contract requires prior approval for portfolio use, we will follow that requirement.

We will not knowingly suggest that a client endorses Mufasa or its services where no such endorsement exists.

We will respect applicable restrictions concerning confidential projects, embargoed materials, commercially sensitive information and other content that is not authorised for public disclosure.

8. REQUESTS TO REMOVE WEBSITE CONTENT

Mufasa aims to ensure that materials published on the Website are used appropriately and that concerns about their publication can be addressed promptly.

If you believe that any text, photograph, video, logo, document or other material on the Website should be removed, you may submit a takedown request by emailing:

[email protected]

Please include, where possible:

  • A description of the material you would like us to remove.
  • The URL of the page where the material appears.
  • The reason for your request.
  • Your name and contact details.
  • Information establishing your authority to make the request, where relevant.

Requests may be made by clients, rights holders, individuals appearing in published materials or other persons with a legitimate concern.

We will review requests in good faith and take appropriate action.

Mufasa may remove, disable access to or replace material in response to a takedown request, including where a client or rights holder requests removal. We may also remove material while a concern is being reviewed.

We aim to handle requests promptly. We may contact the requester for further information where necessary.

Submitting a request does not guarantee a particular outcome or establish that the publication was unlawful. However, Mufasa is committed to resolving legitimate concerns constructively and may remove material at its discretion where appropriate.

Nothing in this section limits any rights or remedies available under applicable law.

9. THIRD-PARTY WEBSITES AND SERVICES

The Website may contain links to third-party websites or use services provided by other organisations.

These third parties operate independently and may have their own terms, privacy notices and practices.

Mufasa is not responsible for the content, availability or privacy practices of independent third-party websites.

You should review the relevant terms and privacy notices before using third-party services or providing personal data to them.

10. LIMITATION OF LIABILITY

To the extent permitted by applicable law, Mufasa shall not be liable for losses arising solely from reliance on general information published on the Website, inaccuracies in indicative calculations, temporary Website unavailability or circumstances beyond our reasonable control.

Nothing in these Terms and Privacy Policy excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

Nothing in this document limits any mandatory rights or remedies available to consumers or other persons under applicable law.

11. CHANGES TO THE WEBSITE AND THESE TERMS

We may modify, update, suspend or discontinue Website features or content from time to time.

We may also update these Terms and Privacy Policy to reflect changes in our business, Website functionality, data processing practices or applicable law.

Updated versions will be published on this page with a revised “Last updated” date.

Where required by law, we will provide additional notice or obtain consent for changes to our data processing practices.

Your continued use of the Website following publication of revised Website terms indicates that you have had an opportunity to review the updated terms. It does not override any requirement under applicable law to obtain consent or provide a specific notice.

12. GOVERNING LAW

These Website Terms and Conditions are intended to operate subject to the laws of Thailand and any other mandatory legal requirements applicable to the relevant circumstances.

Nothing in this section excludes the application of mandatory consumer protection or data protection rights that cannot lawfully be excluded.

It applies to personal data relating to website visitors, prospective clients, clients and their representatives, and other individuals whose personal data we process in connection with enquiries or the provision of our services.

Our services may include video production, photography, event coverage, editing and related production activities.

When we undertake production work for a client or event organiser, the processing of personal data may also be governed by separate client instructions, contracts, event privacy notices and other applicable arrangements.

14. PERSONAL DATA WE COLLECT

  • Production days or hours.
  • Equipment, crew and editing requirements.
  • Travel or location requirements.
  • Other figures and options entered into the calculator.

We may use information submitted to us through the calculator to review your requirements, verify an estimate and prepare a quotation.

If the calculator performs calculations entirely within your browser and does not transmit the information to Mufasa, we will not receive the entered values merely because you use the calculator.

14.5 Technical information

When you visit the Website, our hosting provider or other technical service providers may process technical information necessary to deliver, maintain and secure the Website.

Depending on the configuration of the Website, this may include:

15. HOW WE USE PERSONAL DATA

We may process personal data for the following purposes:

  • To receive, review and respond to enquiries.
  • To understand prospective clients’ requirements.
  • To prepare estimates and quotations.
  • To communicate with prospective and existing clients.
  • To plan, coordinate and deliver agreed production services.
  • To manage client relationships, contracts and project documentation.

  • To comply with legal obligations.
  • To establish, exercise or defend legal claims.

We will not use personal data for purposes incompatible with those described in this Privacy Policy unless we have a lawful basis to do so and provide any additional information required by applicable law.

16. LEGAL BASES FOR PROCESSING

The legal basis for processing depends on the purpose and circumstances of the processing.

Where the GDPR applies, we may rely on the following legal bases.

16.1 Steps before entering into a contract

We may process information you provide when requesting a quotation, submitting a project enquiry or asking us to assess your requirements.

This processing may be necessary to take steps at your request before entering into a contract.

16.2 Contractual necessity

Where you become a client, we may process relevant personal data as necessary to perform our contractual obligations and provide the services you have requested.

16.3 Legitimate interests

We may process personal data where necessary for our legitimate business interests, provided those interests are not overridden by your rights and interests.

These interests may include:

  • Responding to business enquiries.
  • Managing client relationships.
  • Preparing quotations and managing projects.
  • Maintaining appropriate business records.
  • Securing the Website.
  • Preventing misuse and malicious activity.
  • Promoting our services and demonstrating our professional experience where permitted.
  • Establishing, exercising or defending legal claims.

Where required, we assess the impact of this processing on the rights and freedoms of individuals.

16.4 Legal obligations

We may process personal data where necessary to comply with applicable legal or regulatory obligations.

16.5 Consent

Where consent is required under applicable law, we will request it before processing the relevant personal data.

Where processing is based on consent, you may withdraw your consent at any time. Withdrawal does not affect the lawfulness of processing carried out before consent was withdrawn.

Under Thailand’s PDPA, we will rely on an applicable lawful basis under Thai law, which may include consent, contractual necessity, legal obligations, legitimate interests or another basis permitted by the PDPA, depending on the circumstances.

17. HOW WE SHARE PERSONAL DATA

Mufasa handles enquiries and calculation requests internally to assess requirements and prepare responses.

We do not sell personal data.

We may disclose personal data to the following categories of recipients where reasonably necessary and lawful.

17.1 Authorised personnel

Relevant Mufasa personnel may access personal data where necessary to review enquiries, prepare quotations, communicate with clients, manage projects or perform administrative duties.

17.2 Hosting and technical service providers

We may use hosting providers and technical service providers to operate, maintain, secure and support the Website.

17.3 Communication and business service providers

Where used, email providers and other business service providers may process personal data to enable us to receive enquiries, communicate with clients and maintain records.

17.4 Production personnel and subcontractors

Where necessary to deliver an agreed production, we may share relevant project information with authorised crew members, production personnel, freelancers or subcontractors.

We will limit the information shared to what is reasonably necessary for the relevant work and take appropriate steps to protect it.

17.5 Professional advisers

We may disclose relevant personal data to legal, accounting and other professional advisers where necessary for legitimate business purposes or compliance with legal obligations.

17.6 Authorities and legal proceedings

We may disclose personal data where required by law, pursuant to a lawful request from a competent authority, or where necessary to establish, exercise or defend legal claims.

17.7 Business transactions

If Mufasa undergoes a merger, restructuring, acquisition or sale of all or part of its business, personal data may be disclosed to relevant parties where necessary and lawful, subject to appropriate safeguards.

18. CLOUD STORAGE AND INFORMATION SECURITY

Mufasa uses cloud-based services and digital storage systems to support its business operations and the delivery of its services.

Depending on the nature of the work, information stored or processed through these services may include:

  • Client contact details.
  • Enquiries and quotations.
  • Project documentation.
  • Photographs and video footage.
  • Edited production materials.
  • Audio recordings and other digital files.
  • Other information associated with our services.

We select established service providers appropriate to the relevant business function and take reasonable precautions to protect information stored or processed through these services.

Our safeguards may include access controls, account security measures, restricted permissions, secure data transmission, appropriate backup arrangements and other technical and organisational measures designed to protect information against unauthorised access, loss, alteration, disclosure or destruction.

Access to client information and production materials is limited to authorised personnel and service providers who require access for legitimate business purposes.

Depending on the services used and their technical arrangements, information may be stored or processed in Thailand or other countries. Where personal data are transferred internationally, we will take the steps required by applicable data protection law.

Although we take reasonable precautions and use established service providers, no cloud service, storage system or method of electronic transmission can be guaranteed to be completely secure.

We therefore cannot guarantee absolute security. We review our arrangements as appropriate and take reasonable steps to address security risks in accordance with our legal obligations and contractual commitments.

19. INTERNATIONAL TRANSFERS

Mufasa is based in Thailand. Depending on the Website’s hosting arrangements and the services we use, personal data may be stored or processed in Thailand or other countries.

Where personal data are transferred outside Thailand, we will comply with applicable requirements under the PDPA, including requirements concerning the destination country, permitted transfer conditions and appropriate safeguards.

Where the GDPR applies and personal data are transferred outside the European Economic Area, we will use a lawful transfer mechanism where required. This may include an applicable adequacy decision or appropriate safeguards, such as standard contractual clauses.

You may contact us using the details in Section 2 if you would like further information about relevant international transfers and safeguards.

20. RETENTION OF PERSONAL DATA

We retain personal data only for as long as reasonably necessary for the purposes described in this document, unless a longer retention period is required or permitted by law.

Retention periods depend on the nature of the information and the reason it was collected.

In general:

  • Unsuccessful or inactive enquiries may be retained for a reasonable period after our last meaningful communication, taking into account the nature of the enquiry and potential legal claims.
  • Active project enquiries may be retained while assessing a project, preparing a quotation or discussing a potential engagement.
  • Customer and project records may be retained for the duration of the business relationship and any additional period required for contractual, accounting, tax or other legal purposes.
  • Production materials may be retained for the period agreed with the client, as necessary to deliver the services, or for other lawful purposes permitted by the applicable contract and relevant law.
  • Technical and security logs may be retained for a limited period appropriate to security, troubleshooting and operational requirements.

When personal data are no longer necessary, we will take reasonable steps to delete, anonymise or otherwise securely dispose of them, subject to applicable legal requirements and contractual obligations.

21. EVENT FILMING AND PHOTOGRAPHY

Mufasa provides video production, photography and related services that may involve filming or photographing conferences, corporate events, exhibitions, seminars, product launches, public events and other activities organised by our clients or third parties.

Production work may capture speakers, presenters, audience members, participants, employees, contractors and other individuals who appear in footage or photographs.

Identifiable photographs and video recordings may constitute personal data under applicable law.

21.1 Event organiser responsibilities

Events and venues may operate under their own privacy notices, filming notices, registration terms, consent procedures and other data protection requirements.

The event organiser or another responsible party may determine why recording takes place, the intended audience, how the resulting materials will be used and what arrangements are necessary to inform attendees.

Mufasa expects event organisers and clients to establish and communicate the notices, permissions and other arrangements required for their events, in accordance with applicable law and their respective responsibilities.

Where appropriate, Mufasa will cooperate with the organiser or client to follow relevant notices, instructions, contractual arrangements and production requirements.

21.2 Mufasa’s role

Depending on the circumstances, Mufasa may act as a data processor on behalf of a client or event organiser when recording, editing, storing or delivering production materials according to their instructions.

In other circumstances, Mufasa may act as a data controller for its own purposes, subject to applicable law.

Our role depends on the actual arrangements and purposes of the processing.

Where Mufasa acts as a processor, we will process personal data in accordance with applicable contractual instructions and legal requirements.

Where Mufasa acts as a controller, we will identify and rely on an appropriate legal basis for the relevant processing and provide any information required by applicable law.

21.3 Images and recordings of individuals

Our production work is generally focused on the event, its activities, presentations, atmosphere and client requirements, rather than on collecting personal information about individual attendees.

Nevertheless, individuals may be identifiable in footage or photographs.

We will handle these materials in accordance with the applicable production arrangements, instructions, permissions and legal requirements.

We do not assume that an event organiser’s privacy notice automatically authorises every possible use of recorded material by Mufasa. Any separate use for Mufasa’s own purposes must be considered independently and must have an appropriate legal basis and any necessary permissions.

21.4 Requests concerning event recordings

Questions or requests concerning an event’s filming arrangements should ordinarily be directed to the event organiser or client responsible for those arrangements.

Individuals may also contact Mufasa if their request concerns personal data held by us.

We will assess the request according to our role in the relevant processing and the requirements of applicable law. Where another party is responsible for the processing, we may refer the request to that party or assist the responsible party as appropriate.

22. USE OF CLIENT NAMES, LOGOS AND COMPLETED WORK

Mufasa may wish to identify clients and demonstrate its experience by referring to completed projects and displaying examples of its work.

Where permitted by the relevant contractual arrangements and applicable law, we may use a client’s business name and logo to identify the client, describe a project or demonstrate our professional experience.

We may also use selected completed videos, photographs or other production materials in our portfolio, on our Website, in presentations, case studies or other promotional materials where we have the necessary rights, permissions and lawful basis.

Where a client publicly releases or publishes a video or photograph produced by Mufasa, this may indicate that the material has been made publicly available. However, public availability alone does not automatically authorise every subsequent use of that material by Mufasa.

Our use of completed production materials remains subject to applicable contractual arrangements, intellectual property rights, confidentiality obligations and data protection requirements.

Where the client contract requires prior approval for portfolio use, we will follow that requirement.

Where materials contain identifiable individuals, we will consider the applicable privacy requirements and the permissions or other lawful basis needed for our intended use.

Some projects may be confidential, commercially sensitive, subject to a non-disclosure agreement or embargoed. We will respect applicable restrictions when deciding whether to identify a client or display completed production materials.

Clients may contact [email protected] with questions or requests concerning the use of their names, logos or completed work.

23. YOUR DATA PROTECTION RIGHTS

Depending on the applicable law and circumstances of the processing, you may have rights in relation to your personal data.

These may include the following.

23.1 Right to access

You may request confirmation of whether we process your personal data and, where applicable, obtain access to that data and information about how it is used.

23.2 Right to rectification

You may request that inaccurate or incomplete personal data be corrected.

23.3 Right to erasure

You may request the deletion of your personal data where the applicable legal requirements are satisfied.

This right is not absolute. We may need to retain certain information to comply with legal obligations or establish, exercise or defend legal claims.

23.4 Right to restriction of processing

You may request that we restrict the processing of your personal data in circumstances provided for by applicable law.

23.5 Right to data portability

Where the applicable legal requirements are met, you may request to receive personal data you have provided to us in a structured, commonly used and machine-readable format, or request that it be transmitted to another controller where technically feasible.

23.6 Right to object

Where we process personal data on the basis of legitimate interests, you may have the right to object on grounds relating to your particular situation.

We will assess any objection in accordance with applicable law.

Where personal data are processed for direct marketing purposes and the relevant law provides an unconditional right to object, you may exercise that right at any time.

23.7 Right to withdraw consent

Where we rely on your consent, you may withdraw it at any time. Withdrawal does not affect processing lawfully carried out before withdrawal.

23.8 Rights under Thailand’s PDPA

Where the PDPA applies, you may also exercise applicable rights under Thai law, which may include requesting access to or disclosure of your personal data, requesting correction or deletion, requesting suspension of processing, objecting to certain processing, requesting data portability where applicable, and withdrawing consent where processing is based on consent.

These rights are subject to the conditions, exceptions and limitations set out in applicable law.

23.9 Right to lodge a complaint

If you believe that we have processed your personal data in breach of applicable data protection law, you may contact us so that we can review your concerns.

You may also have the right to lodge a complaint with the relevant data protection supervisory authority.

For matters falling under Thailand’s PDPA, the relevant authority is the Personal Data Protection Committee and the competent Thai supervisory mechanisms.

Where the GDPR applies, you may have the right to lodge a complaint with the competent data protection supervisory authority in the EU or EEA, particularly in the country where you live, work or where the alleged infringement occurred.

24. EXERCISING YOUR RIGHTS

To submit a data protection request or ask a question about how we handle your personal data, please contact:

Email: [email protected]

We may need to verify your identity before responding to a request.

We will review and respond to requests within the time limits required by applicable law. We may refuse or limit a request where the law permits us to do so, and we will explain our decision where required.

If your request concerns event footage or photographs that Mufasa processes on behalf of a client or event organiser, we will assess our role and respond or refer the request as appropriate under applicable law.

25. CHILDREN’S PRIVACY

The Website and our services are intended primarily for businesses, organisations and individuals seeking professional video production and related services.

We do not knowingly seek to collect personal data from children through the Website unless this is necessary for a legitimate purpose and permitted by applicable law.

Our event production work may occasionally capture footage or photographs in which children appear. In such circumstances, we will follow the applicable event arrangements, client instructions and legal requirements, including any requirements concerning parental consent or other safeguards where applicable.

If you believe that personal data concerning a child have been collected or used inappropriately, please contact us so that we can assess the situation and take appropriate action.

26. COOKIES AND TRACKING TECHNOLOGIES

The Website may use cookies and similar technologies for purposes such as website functionality, security, analytics and other purposes, depending on the technologies enabled on the Website.

Our separate Cookies and Tracking Policy explains the cookies and similar technologies used, their purposes and how you can manage your preferences.

Please refer to that policy for further information.

Where required by applicable law, we will seek consent before placing or accessing non-essential cookies or using similar tracking technologies.

You can manage your cookie preferences through the cookie consent mechanism provided on the Website, where available.

27. AUTOMATED DECISION-MAKING

The online calculation tool may perform calculations automatically to generate indicative estimates.

These calculations do not, by themselves, constitute a final quotation or contractual commitment.

We do not intend to use personal data collected through the Website’s enquiry and calculation functions to make decisions based solely on automated processing that produce legal effects or similarly significantly affect individuals.

If our processing practices change materially, we will update this document and provide additional information where required by applicable law.
